Akua Donkor sues Akufo-Addo, Bawumia but receives a GHS10k fine instead

A seven-member panel of the Supreme Court presided over by Justice Jones Dotse has dismissed a writ filed by the Leader of the Ghana Freedom Party (GFP), Akua Donkor against President Nana Akufo-Addo and his Vice Dr. Mahamudu Bawumia.

The apex court after dismissing the case also slapped on Madam Akua Donkor a cost of GHc10, 000 after the State asked for GHc50,000.

It was the case of the GFP leader that the president and his vice be ordered to step down following their alleged involvement in acts of corruption captured in Anas Aremeyaw Anas’ an investigative piece on corruption in Ghana football.

Akua Donkor, in her writ, prayed the apex court to order the President and his Vice to step down since their names were mentioned by Kwesi Nyantakyi, former President of the Ghana Football Association (GFA) in the video.

This according to her, is to enable the relevant bodies to investigate the allegations made in the video without hindrance.

WITHDRAWAL FOR SETTLEMENT

In court on Wednesday when the case was called, the panel indicated that the GFP leader has written for the case to be withdrawn for settlement.

But, Mr. Sylvester Williams, a Chief State Attorney in the case told the court that there was nothing to be settled as per the request from the applicant.

He was however obliged the opportunity to move his application for the case to be dismissed for lack of merit.

He argued that the writ filed on June 30, 2018 be dismissed because it is grossly incompetent.

The panel which also includes Justice Agnes Dodzie, Justice Annin Yeboah, Justice Baffoe-Bonnie, Justice Sule Gbadegbe, Justice Samuel Marfu-Say and Justice Nene Amergacher dismissed the application and awarded a cost of GHc10, 000 after the state attorney asked for GHc50,000.

Madam Akua Donkor was not present in court.

Statement of claims

Madam Akua Donkor, who went silent after the National Democratic Congress (NDC), which she supported after her disqualification lost the 2016 election, claimed the President and his Vice are culpable.

She averred that Mr. Nyantakyi, in the video, detailed how the Chinese investors, for instance, invested in Ghana through the payment of bribes to key government officials.

For this reason, Madam Akua Donkor averred that President Akufo-Addo and his Vice, Dr. Bawumia were involved in the deal.

She also stated that the President, who has always believed in the work of Anas, fired some customs officials and judges who were exposed.

Claims

Madam Akua Donkor is, therefore, asking the Supreme Court to order the Attorney General, who is the official advisor of government, to advise the President and his Vice to step down from the highest office in the land since their names were mentioned in the video. She is also asking for a cost.
